If you are purchasing Your Puppy with "NO PAPERS" this Warranty will expire 1 Year from the Puppies date of Birth.
FIVE YEAR WARRANTY
GENERAL HEALTH WARRANTY:
Seller warrants to deliver the puppy as pictured on the website.
Seller warrants that the puppy has been given a minimum of two vaccinations that include but are not limited to TWO Parvo,
One which is a High Titer Vaccine known as NEOPAR. Distemper and a Bordetella vaccination prior to shipping or pick-up. Vaccination record will be shipped with the puppy and are attached to the crate. Or will be provided at pick-up,
CLIENT AGREES TO MICROCHIP PUPPY. You agree that it is essential that both of us have the ability to positively identify the puppy purchased. You have the option of having the puppy micro chipped prior to pick up for $30.00. If not done prior to pick-up then you agree the pet will be microchiped on the FIRST VET VISIT, to provide the microchip number and a copy of the micro chip number on the required vet form. If shipping, the microchip is required, by Continental Airlines. The puppy must be micro cipped prior to departure. The $30.00 fee will be billed to you through Pay Pal. and must be paid prior to the vet check.Should you fail to comply or YOUR VETERINARIAN WANTS TO DO THE CHIP LATER, The warranty is NULL and VOID. In case of claim you must be able to provide proof that it is this puppy in question. THIS IS THE ONLY PROOF THAT IS ACCEPTED.
CLIENT UNDERSTANDS: The puppy,if shipped, will have a health certificate issued by a Texas Licensed Veterinarian. This certificate will certify that the puppy was "Fit For Purchase" upon veterinarian examination and that it was fecal float negative.
YOU MUST Within 2 days of arrival/pickup date allowing an extra day for holidays; take the puppy to your vet to verify the health of the puppy or the warranty becomes null & void. The buyer agrees to have the veterinarian to fill out the vet health sheet and fax this document along with the bill to the Fax number listed below.
5 YEAR CONGENITAL HEREDITARY ( NO NEED TO RETURN THE PET) disorderS known as Heart, Lung, Liver, PRA of eyes, are covered. Within a period of 5 years of the dogs date of birth. If the dog is diagnoses with any above covered condition Client may choose
1. Replacement when the next available puppy becomes avialble of the same sex and price. . Or
2. a refund of ˝ the sale price..THE PUPPY NEED NOT BE RETURNED
Once the buyer receives 2 veterinarian letters, and all other documents requested. One diagnosis from your veterinarian. The second diagnosis from a tenured veterinarian specialist which confirms a diagnosis of a covered hereditary condition and confirms the micro chip number. Once my veterinarian agrees with the diagnosis . Refunds will be issued Within 60 days of my veterinarians acceptance of the diagnosis.
2 YEAR COMMUNICABLE DISEASE WARRANTY: Should the puppy you purchased developed and loose it's life to a virus or should it loose it's life within this 2 year period to any hereditary congenital condition diagnosed/confirmed by veterinarian specialist. You will be offered a puppy of your choice of the same purchase price from the next available litter of the same breed and sex. Delivery or shipping expenses are not included For this part of the warranty you must be able to produce veterinarian records of proper and timely vaccinations. You must provide proof of the claim in the form of a written necropsy/autopsy done by the state lab. Once all records have been provided to me along with the puppies microchip I will then have my veterinarian confirm the diagnosis with your veterinarian. Once confirmed the warranty will be honored with the first available puppy...
RETURN AND EXCHANGE POLICY. Should your vet find the puppy unfit for purchase, Please return thr puppy immediatly for a Full Refund of the purchase price. If shipped the puppy must be returned within 2 days. for the refund.Continual care items as Ear mites, parasites, coccidia. giardia,upper respiratory are not serious health problems If the puppy is found with these conditions you must have the puppy treated at your expense.
If the puppy becomes ill due to Parvo within 2 days, or 5 days Distemper. The puppy may be returned for an exchange. Or seller will make arrangements to pay for treatment at sellers veterinarian office. If returning A vet diagnosis letter of his findings, health check sheet, vet notes, and supporting tests and documents must be faxed prior to the return. Upon my vet speaking with your vet and agreeing with the diagnosis, puppy will then be allowed to be returned. Shipping/delivery charges are the responsibility of the buyer. Seller does Not pay for Any Client occurred Veterinarian Bills.
The seller will not accept any returns of the pet, including but not limited to allergies, Landlord/Tenant, marital, adjustment problems, change of mind, neighbor does not like breed. etc.
REPLACEMENT The buyer must pay for all related shipping costs. All paper work requested by seller, including the microchip number, must be provided prior to the replacement will
be made. . In the case of death. Microchip must be returned to the seller along with euthanasia treatment sheet from the attending vet office
A REPLACEMENT Will be made available to the buyer from the next available litter in which a similar puppy is available. Buyer has the option to have a replacement of the new puppy anytime within the next 12 months from the date when the first puppy died or was returned. Sex, color and size of original puppy will be considered but NOT guaranteed in the replacement puppy.
Hernias. Known or unknown. Should the puppy have a hernia and the vet feels it warrants repair it will be done prior to leaving us. As some hernias resolve on their own or some puppies are to tiny the repair may need to be done at the time of spay or neutering.
Hernias are not life threatening and are not a reason for return or refund of the puppy.
CURRENT VACCINATIONS. Your pet is current on vaccinations and you agree not to allow the vet to revaccinate your new puppy until you have had him for a minimum of 10 days.
Should a puppy be vaccinated prior to this or on his first vet visit this warranty will become Null and Void.
LIMITATIONS & DISCLAIMER: Under no circumstances will cash refunds be given unless provided in this warranty.
SHIPPING is an additional service, not a condition of sale. Any delays by the airlines due to weather, canceled flights etc.. are not terms for a refund of this purchase. Seller will make every effort to provide shipping as soon as your airline permits. If purchasing for a gift it is suggested that you choose the closest airline that Continental ships puppies to. Continental is the only temperature controlled flights and over 98% of these flights are non-stop from Houston, TX. Once the puppy has been delivered to the airlines all further related costs are the responsibility of the buyer. This is established by the law. Seller reserves the right to delay or reschedule the flight due to emergencies beyond our control, vet says the puppy is not ready, or puppy not feeling well. These are Not a basis for a REFUND.
VET PET INSURANCE Buyer understands that this document is a Condition of Sale. Not Pet Insurance. Buyer understands he is responsible for the puppy’s care. The buyer assumes any and all expenses related but not limited to vet bills for checkups, diagnosis, treatments, health care, hospitalizations, accessories, euthanasia fees, cremation or disposal fees, etc. Veterinarian care is expensive, and should be considered prior to making the purchase. Vet charges are out of sellers control. To avoid an unseen medical charge. It is suggested that Vet Pet Insurance be purchased prior to arrival of the puppy. Seller suggests VPI Pet Insurance from California. There are many policies av available including some Home Owners Policy will cover pets. Other options are having sellers vet treat, returning the dog, euthanasia option, or sign over to a shelter/vet clinic. These are decisions only able to be made by the new owner. Seller has no responsibilities for actions or financial decisions made by the buyer. VETERINARIAN As a new puppy owner you will rely on 100% on the veterinarians professionalism and honesty, It is suggested that you find an established veterinarian office. Owned by a veterinarian who has been treating for more than 10 years. Not a Banfield or VCA hospital. These two are known to charge well above average fees, pay commissions to veterinarians and staff for selling products . Management encourages tests you may not need. and you may never see the same vet twice. most veterinarians in these locations are new to the field and have not much experience treating. Most honest vets do not charge a fortune for a diagnosis. Most can rely on physical symptoms to determine if it has a deadly illness and decide if euthanasia or treatment should be applied.
The seller disclaims any and all implied warranties of merchantability and fitness and under no circumstances the seller can guarantee expected size, bite, personality, temperament, color, ear set, patella luxation, breeding ability, house breaking ability, coat type, or generations of pedigree.
REGISTRATION: Seller sells Havanese puppies with No papers, Pet registered (no breeding rights) Full Registered (breeding rights). Seller is a member in good standing with AKC, UAB,CPR and APR Registration gROUPS. Papers AKC (full breeding rights) UAB,CPR or APR pet registrations will be provided once the pet has been spayed or neuters from one of these groups. Most AKCregistrations are sent with the puppy. Should the paperwork not yet be back or submitted by seller, It will be sent to you once received Usually this takes no longer than 3 months. However, on occasion a mistake will be made and take the seller a little bit if time to redo paperwork. You agree to be patient.All pick of litter puppies are usually registered and named prior to you recieving the puppy and it's paperwork. AKC does allow a name change if done prior to breeding or showing. For any unforeseen reason should the puppy you purchased registered not be able to be registered with the above clubs. Seller will issue a 10% refund to the buyer or exchange the puppy.
The warranty will NOT cover neglect, abuse, lost or stolen pets. This warranty is non-transferable.
The value of the pet for the purpose of this guarantee is solely the original purchase price, and does not include any additional prices declared by the buyer. No replacement or refunds will be given if the Puppy has been bred.
SIZE EXPECTATIONS: TOY HAVANESE 8LBS AND UNDER. Seller relies on past experience and the size of the parents when determining future size. As the Toy Size of this breed is bred down from the regular size Havanese dog. Should the pet be at 1 year, in good physical condition (not over weight) be larger than 2 lbs over the quoted weight. Seller will refund 5% of the puppies purchased price. This warranty is void if previous refunds, discounts or compensations have been applied.
EUTHANASIA: Within the warranty period, the buyer may authorize his/her vet to euthanize the puppy ONLY if it was found with a life threatening/deadly communicable disease (Parvo and distemper) or only with a deadly congenital disorder.
To maintain the warranty the pet is to be Spayed or Neutered prior to the age of 1 year. Or the warranty will expire at One Year.
Placement: Should you find you are no longer able to provide a home for this puppy you may return him to me. The dog must be returned to my home. I do not pay for shipping fees and am only able to pick up the pet on a Saturday prior to 8:30AM at Continental Airlines Houston Bush Int.
The dog must have been microchipped by the terms of warranty,be current on vaccinations, heartworm and be parasite free. If you are shipping the pet..these doucuments must be sent 48 hours prior to departure from your veterinarians office. Upon return you must give to me shot records. Rabies tag/certificate and registration papers.(if applicable) You understand that upon return you are turning ownership over to me and are due no compensation in any form from me. I can only accept trained, non agressive dogs back into my home. All of my dogs, including males, are good with children and other dogs. I wish to keep this harmony and safety for my children and dogs. Should you have neglected training and raised an aggressive dog, I will not accept the return. As once the puppy leaves my home I am no longer responsibile or in control of training or temperament.
All claims for special, incidental, and consequential damages are hereby excluded.
Do not expect anything else that is not written on this contract.
This Warranty complies with the Texas Laws Buyer agrees the warranty is governed by the sate of Texas and its terms and provisions shall be construed and applied in accordance with the laws of Texas. No other State laws shall govern or are considered in this agreement of sale. Venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in Waller County, Texas Seller is entitled to attorney fees arising out of any litigation involved with this contract.
By payment you have accepted ownership to the puppy listed And have become the legal owner of said puppy.
Buyer agrees to abide by the terms and conditions set forth.
